Couple suing over golf balls hitting house

HAMILTON, Mont. (AP) — A couple whose house was built adjacent to a western Montana golf course is seeking an injunction to prevent the use of the 18th hole unless the course is modified to prevent golf balls from striking their property.

Robert and Katherine Brady filed the lawsuit against Hamilton Golf Club in December. They also are seeking damages from Ravalli County, which leases property for the golf course's back nine holes.

The couple purchased the house in 2009 and report collecting more than 1,350 golf balls each year. The lawsuit claims many balls have hit their house and vehicles, damaging them.

The Ravalli Republic reports (http://bit.ly/wsKmZr) when the subdivision was being considered, golf course staffers told county commissioners a conflict with property owners was likely. They suggested ball-blocking walls and notifying potential landowners.
