State: Health insurer must pay surrogacy costsBOZEMAN, Mont. (AP) — The state is ordering a health insurer to pay the medical costs for a Bozeman nurse's surrogate pregnancy. The Bozeman Daily Chronicle reports (http://bit.ly/s1gq2Q ) the Montana Commissioner of Securities and Insurance notified New West Health Services on Nov. 1 that it has to reimburse Anicee Acosta-Yearick for costs associated with her 2009 surrogate pregnancy. Acost-Yearick and her husband sued New West for more than $11,500. Attorney Jameson C. Walker wrote that New West's policies attempted to exclude coverage for surrogacy, but the exclusion was on the list of fertility treatments that aren't covered. He said the policy does not exclude coverage for the pregnancy of an insured surrogate.
