Court upholds restitution in child porn caseBILLINGS, Mont. (AP) — A federal appeals court has upheld that a Billings man convicted of receiving child pornography must pay $3,000 in restitution to one of the children in the collection. Richard J. Baxter was sentenced last year to more than 17 years in prison for receipt of child pornography. He also was ordered to pay $3,000 in restitution to the child, known by the pseudonym "Vicky," whose father videotaped his abuse of her and distributed the images online. Baxter appealed the length of the sentence and restitution. The 9th U.S. Circuit Court of Appeals on Wednesday upheld both. The court says it agreed with the federal prosecutors' assessment that the $3,000 was fair and reasonable and would cover a year and a half of therapy for the girl. |
