Three Forks murder suspect may withdraw plea

BOZEMAN, Mont. (AP) — A 38-year-old Bozeman man accused of killing a woman and disposing of the body by burning it in a barrel near her Three Forks home may withdraw his guilty plea.

Jay Myran was to be sentenced Thursday for the May 12, 2009, death of his 53-year-old ex-girlfriend Gayle Brewster. But his attorney, Peter Ohman, argued during the hearing that a statement from Myran's teenage son was not made available to the defense until after the elder Myran pleaded guilty to deliberate homicide and evidence tampering.

Ohman, who said the statement could clear his client of the most serious charges, argued that the defense did not have the information when deciding how Myran should plea. The attorney did not elaborate on the teen's statement.

District Judge Holly Brown agreed and said the defense is allowed to scrap the guilty plea. Attorneys have until Oct. 1 to file a motion to withdraw.
